Terms of Service

Welcome to newma. These Terms of Service (“Terms”) govern your use of the newma website, audit reports, paid modules (fixkits), MCP server access, and all related services (collectively, the “Service”).

newma is operated by Shookin, a sole proprietorship registered in the Republic of Korea (“we,” “us,” or “newma”).

By using the Service — including running an audit, viewing a report, or purchasing a module — you agree to these Terms. If you do not agree, please do not use the Service.

newma is an AI-powered product-market fit audit tool. You provide a website URL (and optionally social media handles and context about your product). Our system:

1. Crawls your website and public social media profiles
2. Searches publicly available discussions on Reddit, YouTube, and the web
3. Identifies competitors and analyzes their public positioning
4. Generates customer personas based on real market evidence
5. Simulates how those personas would discover and evaluate your product
6. Produces a report with scores, findings, and an action plan

Paid modules (fixkits) extend this by generating marketing assets, monitoring relevant conversations, or rewriting messaging — all based on your audit data.

newma does not currently require account creation, login credentials, or passwords. Access to your audit report and paid modules is managed through unique, token-based URLs. You are responsible for keeping your report URLs secure. Anyone with access to your URL can view your report or use your MCP connection.

If we introduce accounts in the future, we will update these Terms accordingly.

You must be at least 16 years old to use newma. By using the Service, you represent that you meet this age requirement.

If you are using newma on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

You agree not to:

• Submit URLs or data you do not have the right to analyze (e.g., a competitor's internal tools behind a login)
• Use the Service to harass, defame, or harm any person or business
• Attempt to reverse-engineer, scrape, or extract the underlying algorithms, prompts, or models used by newma
• Overload the Service through automated bulk requests (e.g., scripting hundreds of audits)
• Resell, redistribute, or white-label audit reports or fixkit outputs as your own service without written permission
• Use the Service for any illegal purpose
• Attempt to access other users' reports or data

We reserve the right to block access to the Service for anyone who violates these terms, without notice.

The free audit report is provided at no cost and requires no payment information. It includes a product-market fit analysis with scores, personas, journey simulations, and an action plan.

We reserve the right to:

• Limit the number of free audits per URL or IP address
• Modify the scope or content of the free audit at any time
• Discontinue the free audit offering (existing reports will remain accessible for their retention period)

What you get

Paid modules generate marketing assets and insights based on your audit data. Modules are delivered as downloadable packs (markdown/JSON files) or accessible via MCP server connection — not as a gated dashboard or web application.

Pricing and payment

• All prices are listed in USD or KRW and may not include applicable taxes depending on your jurisdiction.
• Payment is processed by our designated payment provider. We do not handle or store your payment card details.
• Specific pricing, billing frequency (one-time or subscription), and what each module includes will be listed on the purchase page at the time of transaction.

Refunds

Due to the nature of AI-generated deliverables (content is produced immediately upon purchase), all sales are generally final.

However, if a module fails to generate any output due to a technical error on our end, we will either re-process the module or issue a full refund at your choice. Contact us within 14 days of purchase.

Subscription and cancellation

If you purchase a subscription-based module or MCP server access:

• You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• After cancellation, your MCP server access will stop at the end of the paid period.
• Your audit report (the free part) remains accessible regardless of subscription status.

newma offers an MCP (Model Context Protocol) server that lets you access your audit data and marketing modules inside AI agents like Claude, Cursor, or ChatGPT.

• MCP access is authenticated via your unique report token URL.
• MCP server access is part of the paid product. A free trial period may be included.
• We may rate-limit or throttle MCP requests to maintain service quality.
• MCP access depends on the availability of third-party AI agent platforms. We do not guarantee uninterrupted compatibility with any specific platform.

Your content

You retain all rights to the content you submit (your website URL, social handles, answers to context questions). By using the Service, you grant us a limited license to access, crawl, and analyze the publicly available content at the URLs you provide, solely for the purpose of generating your audit and related modules.

Your audit report and module outputs

The audit report and any fixkit outputs generated for you are yours to use for your business purposes. You may share, reference, or publish your own report.

You may not:

• Resell or redistribute reports or module outputs as a commercial service
• Claim that newma-generated content represents our endorsement of your product
• Remove or alter newma attribution if you share the report publicly

Our intellectual property

The newma name, logo, website design, analysis methodology, prompts, scoring system, and all underlying technology are the intellectual property of newma. You may not copy, reproduce, or create derivative works based on our methodology, interface, or system without written permission.

newma's analysis, scores, personas, journey simulations, and recommendations are generated by AI (specifically, Anthropic's Claude language model) based on publicly available data.

Important:

• AI-generated content may contain inaccuracies, misinterpretations, or incomplete information.
• Audit scores and recommendations are analytical opinions, not guarantees of market performance.
• Personas are evidence-informed simulations, not real people.
• Competitor analysis reflects publicly visible information at the time of the audit and may not capture the full picture.
• We do not guarantee that following the action plan will produce specific business results.

Use newma's output as one input in your decision-making, not as the sole basis for business decisions.

newma crawls and analyzes publicly available information from websites, social media platforms, Reddit, YouTube, and other public sources. We do not access private accounts, paywalled content, or data behind login walls.

The data we collect from third-party sources is subject to those platforms' own terms of service. We access this data through authorized APIs and services (Firecrawl, Apify, Tavily) and use it solely for the purpose of generating your audit.

We are not responsible for the accuracy, completeness, or availability of third-party data.

The Service is provided “as is” and “as available.” We make no warranties, express or implied, regarding:

• The accuracy or completeness of audit reports or module outputs
• Uninterrupted or error-free operation of the Service
• The fitness of the Service for any particular business purpose
• The results you may or may not achieve from using our recommendations

To the maximum extent permitted by applicable law, newma shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, business interruption, or loss of data.

Our total liability for any claim related to the Service shall not exceed the amount you paid to newma in the 12 months preceding the claim, or $100 USD (whichever is greater).

You agree to indemnify and hold newma harmless from any claims, damages, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

We are not liable for any modification, suspension, or discontinuation of the Service.

These Terms are governed by and construed in accordance with the laws of the Republic of Korea.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea, specifically the Seoul Central District Court.

If you are located in a jurisdiction where local consumer protection laws grant you rights that cannot be waived by contract, those rights apply to you regardless of this clause.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and newma regarding your use of the Service.

We may update these Terms as the Service evolves. When we make material changes, we will update the “Last updated” date at the top. For significant changes that affect your rights or obligations, we will make reasonable efforts to provide notice (e.g., a banner on the website).

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
